OENrv1:TT <br /> DiICC%Of <br /> We have reviewed your most recent request for a temporary <br /> occupancy of the residence at 2019 Colby Avenue to assist <br />' you through the Christmas Season. It is our opinion that <br /> while any non-residential use of the building over and above <br /> this seasonal occupancy would require action by the Planning <br /> Commission and City Council, we can be somewhat flexible in <br /> this one instance due to certain misunderstandings between <br /> you and the City. <br /> The City will therefore grant you permission to occupy the <br /> structure at 2019 Colby, provided that you agree to the <br /> following conditions: <br /> 1. That the use of the building will be limited to over- <br /> flow display and sales space for floral arrangements. <br /> 2 . That the time of occupancy will be strictly limited <br /> from this date through December 29, 1974. <br /> 3. That the building will be vacated of all retail acti- <br /> vity by December 30 , 197�1. <br /> 4 . That any future occupancy for retail purposes will be <br /> contingent upon a rezone of the property to B-1, <br /> Neighborhood Shopping. <br /> 5. That in absence of any rezone action on the property, <br /> any future occupancy of the structure will be con- <br /> fined to residential use. <br /> 6. That occupancy of the building for •retail purposes <br />' for this limited period in no ways binds the City to <br /> a particular course of action in its review of a <br /> rezone application. <br /> - continued - <br />
