8 <br /> Project:Combined Sewer Improvement"E" <br /> Change Order no. 1 <br /> Change Order Effective Date: 1/16/04 <br /> Exhibit A—Description of Changed Work <br /> New item added to this change order. <br /> #38 — Shore Avenue —Add on $180,000.00 estimated cost to the contract. <br /> Exhibit B—Justification <br /> This existing sewer and drainage improvements project was modified to include <br /> other drainage improvements along Shore Avenue. <br /> Two existing downdrains along Shore Avenue (3417 Shore and 3509 Shore) <br /> collect street runoff and city drainages discharge to the BNSF ROW through <br /> private property; portions of these lines have failed and are non-functional. <br /> These lines are broken near the top of slope and have caused sloughing and <br /> slope failure to occur on private property. These line were installed in the mid- <br /> 1960's to facilitate development in the area and ultimately evolved and expanded <br /> to receive drainage and street run-off in the surrounding Shore Ave and Mukilteo <br /> Blvd area. These lines as existed, posed a continuing problem due to their <br /> location, potential for further slope damage and the uncontrolled discharge of <br /> surface water. <br /> Upon review of these two locations visited by the City's drainage/slope outside <br /> counsel, Karen Wiley, it was recommended that this City drainage be removed <br /> immediately from private property. <br /> A site evaluation determined one feasible and cost effective solution; to route the <br /> drainage to an existing City utility easement at the north extension of Sound <br /> Avenue, thus eliminating the two failed downdrains and avoiding further slope <br /> erosion. This was based on the fact that one of the owners adjacent to the <br /> easement was building a new home and had recently permitted a new downdrain <br /> with BNSF. The owner agreed to transfer the downdrain to the City (and allow a <br /> right of entry to construct the improvement) if the work was completed as <br /> expeditiously as possible. <br /> This work was done via change order because it is similar work, it was needed <br /> on a time critical schedule due to the failed pipes and the need for immediate <br /> replacement, the potential for further damage, and the limited time to perform the <br /> work. <br /> 45 <br /> Exhibit A <br /> Page 3 of 3 <br />
