., ,
,I
i b. Conclusion: '1'he unusual circumstances applying to the
sitP is trie fact that the clinic building and its
current sign are on the rear of the lot and so not
easily seen from Colby.
Criterion rio. 2•
'lhat such variance is necessary for the preservation and en-
joyment oY a substantial property right of the appellant pos
sessed by the owners of other properties in the same vicinity or
zone.
a. 1'indina: Other clinics along Colby and licyt whicB are
governed by t.he same siyn reyulations as the Applicant's
site riave signs larger than the code allows. 'rnis has
occurred because in the past sign permits were issued
wititout being reviewed for comp] iance with the zoning
code. 'i'his probably occurred because tlte sign code is
administered by the Uuildiny Yermit Department and is
ttle only regulation for siyns in most commercial and
business zones in the City. Only the U-1 zane and the
residential zones have specific requirements in the
zonin code and this was overlooked w11en permits were
issued. 'Phe Ylanning Uepartment is now reviewiny sign
permit applications and when the Applicant's sig pereit
application was reviewed it was discovered that the sign
rie was proposiny exceeded zoniny code requirements.
Some examples of signs that have been installed in the
last tew years t11at exceed the zoniny code requi.rement
of sixteen square feet on ttte face of the building are
the Lverett Clinic at 39th and Colby which has a 72
square Yoot monument sign and Everett 1'amily Practice
Clinic on 43rd and lioyt which has a 4S square foot pole '
sign on Colby and one also on 4Jrd Street. lr, addition,
most of the other clinics on Colby have pedestal siqns
near the side walk that are approximately 20 syuure feet
in area.
b. Conclusion: Grantiny a variance to allow either a 72
square foot monument sign or a 48 square foot pole siyn i
would allow a property right possessed by others in this '
vicinity and zone. I
Criterion No. 3•
`Plat trie authorization ot sucri variance will not be materially
detrimental to trie public welfare or injurious to property in the
vicinity or zone in which the property is located.
a. I'indina: Since most of Colby from 2nd Street south to
43th Street is zoned multiple family it could be
materially detrimental to the public welfare to allow
overly large signs in a residential zone suct as are
allowed in commercial strip zones such as Lvergreen Way.
lioweaer, the clinics with laryer signs than the code
allows currently in existence along Colby and Iloyt are
not aesthetically offensive and so it would seem
reasonable to allow a similar variation from trie code
requirements.
No comments have been received from notices sent to I'
property owners within 300 feet and there does not
appear that there would be any view blockage.
I
