Federal law requires public
performances of copyrighted material to be licensed. A major copyright owners' association,ASCAP,
negotiated a standard municipal license with the International Municipal Lawyers' Association. The license
fee varies with the size of the city. A city of our size pays $600 per year. For this small amount, the City
will be in compliance with copyright law and may lawfully use all ASCAP works. For this year, the Parks
Department is willing to pay the fee out of its budget. In future years, the Parks Dept. would like other
departments to contribute to the fee because the license benefits many other City departments.
RECOMMENDATION (Exact action requested of Council):
Authorize the Mayor to execute a License Agreement with the American Society of Composers, Authors and
Publishers for the Use of Copyrighted Material
no
