Jim Fagerlie
From: G. Paul Carpenter(pcarpenter@andersonhunterlaw.comJ
Sent: Wednesday,April 20, 2011 5:36 PM
To: Jim Fagerlie Qim@premiumconslruction.com)
Attachm ents: 20110420160505.pdf
Jim, have attached Iwo differen[copies of string of emails beriveen me and David Hail re: the posting
and extension.
According to my notes we met with the reps(rom the tiry on March 3 to discuss the issues/permit/plans
and mndemnation notice. We had met with Hall and Kevin Fagerstrom a few days or week before. We
were told that if you submitted plans acceptabte to the city within 2 weeks they would allow the
condemna[ion posting lo come down or at the very least allow you to post that the March 28 deadline
had been postponed for 2 weeks. You submitted your plans a few days later and I emailed Hall on March
7 to make sure he had received a copy or had heard from Mr. Lee.He responded with the email
attached.
I talked to Hall on the 14h or 15h and he confirmed you had done what you had been asked to do. He
said you were acting in good faith and rold me that ihe city would consider"down grading" the notice
or at the very least extending the deadline by 2 weeks.
On March 16 I sent Hall an email, copy attached to contirm that he had received a copy of your email to
Tony Lec updating the plans as requested and informing him how important it was for the deadline to
be extended and that I was still waiting for the city to do this.As stated in my email I had called and left
a vm for him earlier. I received no response and in fact lek at leas.4 more vm's for him over the next
several days with no response. I didn't didn't get a call from him until March 25, the day the city
removed the posiing, but by then you had lost tenants who are now demanding re•iowtion fees from
you of$2000 each.
Aiso, the week of March 27, I talked to Matt Brady, the atty representing the tenants and he was
trustrated in that he said hc was being told by the city ihat the deadline would bc extended, but it
wasn't happening and the deadline was quickly approaching. As you know the postin;didn't come down
until the 25th,which was a Friday with the deadline the following Monday. Now you have 5 tenants
daiming you owe them$2000 each because they felt like they had to move out even thouh the city
ultimately changed the date. This should not havc happened.
