, . <br /> PLANNING DIRECTOR DECISION <br /> Revisw P�ocess II M78-96 <br />!, January 17, 1997 <br /> The City of Everett Pianning Department grants approval of a request by Robert <br /> Fankhauser to construct a rotaining wall approximately six feet in height within <br /> i the rear setback at 3727 Colby Avenue. <br /> Section 39.150 of the Zoning Code allows rockeries and retaining walls in <br /> required building setback areas if the rockery or wall is; <br /> a. not being used for direct structural support of a building; <br /> b. is reasonably necessary to provide support to a cut or slope; <br /> c. will not obstruct or interfere with the vision of vehicles or pedestrians <br /> using the street or driveways; and <br /> d. is 36" in height or less. <br /> In situations where it is necessary to build a rockery or retaining wall higher than <br /> 36" within the building setbacks, the Planning Director may authorize a higher <br /> rockery or retaining wall using Review Process II. <br /> The Planning Director approved the additional height based on the following. <br /> The subject property drops down approximately 6 feet from the alley. A retaining <br /> wall needs to be installed to provide off-street parking off the alley. <br /> The applicant may appeal the Planning Director's decision within 14 days of the <br /> date of this decision. Appeal forms are available from the Planning Department <br /> and must be submitted along with the required filing fee.
