(S.E. corner. of Pacific ind Oakes . ) After visually viewing the subject property and considering all the testimony and ouestions regarding the application, it was moved Uy Mr. Cronin, seconded by Mr. Ingram, and on the taking of a vote Mr. ingram, Mr. Cronin, and hir. Graff voted in favor of the variance wliile b7r. Champion was opposed. The reasons for granting the variance are as follocas: 1. Th� proposed new structure will not be detrimental to the surrounding area. 2. There will be no adverse effects on the neighborhood. 3. The other three corners of the intersection are not required to have yard setbacks . In granting the variance on yard setbacY.s , the Board stipulated that a sideyard of 10 feet must be maintained on the east side of the property as indicated by the applicant as being their intention. A hearing was held on the application of Dr. Wendt requesting permission to extend a deck 4 to 5 feet into the North side yard on the S.E. Corner of 40th and Colby . Ingram and unanimously carried to grant the applicants request for the following reasons : 1. There will be no adverse effect on the surrounding area. 2. This will permit better utilization of the land area. 3. Because of the 60 foot width of 40th Street and the deadening of this street at the rcar of the subject property no appreciable effect would be forthcoming on traffic movement.
