ORDER ON RECONSIDERATION <br />HEARING EXAMINER PRO TEM <br />OF THE <br />CITY OF EVERETT <br />IN THE MATTER OF THE APPLICATION <br />OF JOHN COBB FOR APPROVAL OF A <br />REVIEW PROCESS III <br />Backs�round <br />RPIII #06-004 <br />John Cobb (Applicant), through his representative, Rod Wickham of RAD Design, <br />requested relief from Everett Municipal Code (EMC) 19.7.020 to permit the construction <br />of a detached garage on property located at 5108 Colby Avenue, Everett, Washington <br />(Subject Property). Relief was required from both the maximum permitted height and <br />the maximum permitted square footage of an accessory structure. <br />A hearing was held before the Hearing Examiner Pro Tem of the Ciry of Everett <br />(Hearing Examiner) on January 25, 2007. dn February 8, 2007, the Hearing Examiner <br />issued a decision on the matter fnding: <br />The request of John Cobb for relief from the height and square footage <br />restrictions to permit the construction of a detached accessory building on <br />property located at 5108 Colby Avenue is granted in part and denied in <br />part. <br />The exceptfon from the height restrictions of EMC 19.7.020(H) is <br />GRANTED. The detached accessory building shall be no greater than 22 <br />feet 2 inches in height. <br />The oxception from the square footage restrictions of EMC <br />19.7.020(B) is DENIED. The detached accessory building shall have a <br />footprint of no greater than 500 square feet, for a total of 1,000 square feet <br />for both levels. <br />Findings and Decision, Febtuary 8, 2007, Page 1. <br />Osi February 26, 2007, the Hearing Examiner received correspondence from lhe <br />applicant in regard to the February 8, 2007 Decision. [Supplemental Exhibit 1].
