PLANNING DIRECTOR DECISION <br />ACCESSORY DWELLING UNIT <br />REVIEW PROCESS I #03-020 <br />The City of Everett Planning Director grants approvai of a request by Dana d� Jim <br />Strickland at 921 Colby Av�nue to convert a portion of the ezfsting residence into an <br />accessory dwelling unit with the following conditions: <br />The applicant must comply with all 13 criteria of Section 39.020.D of the City's <br />Zoning Code (as summarized belaw), as wel� as all other provisions of the Citys <br />Zoning Code and all other applicable City codes. <br />2. This project must comply with the current City of EvereMBuild�ng Code. A building <br />permit is required for the work vlhich is proposed to be done on site. <br />3. Parking must be per City Zoning Code and City Design and Construction Standards <br />for Development. <br />Accessory dweiling units are permitted subject to approval by the Planning Director using Review <br />Process I. The Planning Director, using Review Process I, is authorized to "...approve, <br />disapprove, or approve with conditions the use proposed by the applicant." (Subsection 41.100.B) <br />If no appeal is filed in response to the Planning Director's determination, the decision will be <br />considered final. If an appeal of the decision is filed, such an appeal must be submitted to the <br />City's Hearing Examiner. <br />Subsecfion 39.020.D of the Zonina Code establishes 13 criteria by which such proposals must be <br />evaluated. These are as foilows: <br />1. An accessory dwelling unit may be estabflshed in an existing single family dwelling <br />unit, on lots containing at least 5,000 square feet, by one or a combination of the <br />following: <br />a. alteration of the interior space of the dwelling, <br />b. conversion of an attic, basement, attached garage, or other previously <br />uninhabited portion of a dwelling or attached accessory structure; or <br />c. addition of attached living area onto the existing dwelling. <br />The subject lot is approxirnateiy 5,500 square feet in area. The applicant will be converting <br />a portion oi the basement into a new living unit. <br />2. Each single family dwelling on a legal building lot shall not have more than one <br />accessory dwelling unit. No accessory dwelling may be located in any detached <br />accessory structure. <br />The proposed action is for one accessory dwelling unit on site. The proposed accessory <br />dwelling unit will be incorporated into the existing single family residence on site. <br />3. One of the dwelling units shall be occupied by one or more owners of the property as <br />the owner's permanent and principal residence. <br />The owner of the property has submitted a certificate of ownership which states that one of <br />the units will be owner occupied. This certificate will need to be renewed with the City each <br />year to insure that one unit remains owner occupied. <br />
