A separate permit and approval would be required for any proposed accessory dwelling unit <br />located al a site other than the subject property. <br />12. In addMion to the condidons of approval �•equlred by this p�rtnR the aeussary <br />dwelling unit shall automatically expiro whenewr: <br />a. The ac��essory dweiling unit is substantiaily altered and cs thus no longer in confortnance <br />with the plans approved by both the Planning Direclor and the Building Offiaal; or <br />b. The subject lot ceases to maintain at least three off sheet parking spaces; or <br />c. The applicant ceases to own or reside in either the principal or the accessory dwelling <br />unit. <br />13. The appltcant shall provide a covenant sultabla for recordinp with the eovnty auditor, <br />providing �otice to futuro prc�porty owners or lony term lesson of th, subJect <br />property that the eaist�ncs ot'th� accessory dwalllny unit is �ndictted upon the <br />occupancy ot either the accessory dwelling unit or the p�incipal dw�lling by th� <br />penon to whom the accessory dwelling unit permit has been Issu�d. Th� cov�nant <br />shatl also require any owner of the proparty to notify a prospectiva buyer of ths <br />limitations of th(s Sectfon and to provide for the romovyl of improv�mantr added to <br />convert the premises to an accesaory dwelling unit and the restorallon of the site to a <br />aingle family dwelifng in the event that any canditiort of approval is violatad. <br />The applicant has submitted xhe accessory dwelling unit covenant and will be required to <br />record +he form prior to issuance of any building permits on site. <br />APPEALS: This determination may be appealed to the Land Use Hearing Examiner. Any such <br />appeal must be filed within 14 days of the date specified below. Appeal fortns are available from <br />the Planning Department and must be submitted along with the required filing fee.
