A hot drink vending
machine was installed to complement the cold drink and snack machines. This is an inadequate solution.
Employees and visitors to Everett Station do not have on-site access to prepared hot food. The Station Café
is not anticipated to reopen before July 2004. As an interim solution, staff recommends that the City enter
into a Professional Services Agreement with Bruce Barstow, d/b/a Dog Day Afternoon, to provide hot food
and cold beverages from a portable vending cart. Dog Day Afternoon will be allowed to operate outside of
the Everett Station building and to store supplies and equipment in the building. Dog Day Afternoon will
operate for a 30-day trial period during which time hours of service and product availability will be
established. No compensation is due during the first 30-days of operation. During the trial period, Dog Day
Afternoon will negotiate a compensation plan with the City. If a mutually agreeable compensation plan is
not negotiated, the agreement will be terminated. The City may terminate the agreement at any time with at
least a three-day notice, and the agreement terminates on December 31, 2004.
RECOMMENDATION: Authorize the Mayor to sign the Professional Service Agreement with Bruce
Barstow, d/b/a Dog Day Afternoon.
R]NA1/042804 DogDayAftmn Agnrmt@ES
3
