FINDINGS AND RECOMMENDATION OF THE HEARING EXAMINER OF THE CITY OF EVERETT IN THE MATTER OF THE APPLICATION OF DOMESTIC REALTY COMPANY FOR APPROVAL OF A REZONE REZONE #04-004 RECOMMENDATION: The area-wide rezone for the property depicted in exhibit #5 (attached hereto) and legally described herein should be granted, and the subject property should be rezoned from an R-2, Single- Family Detached Medium Density Residential designation to an R-1A, Single-Family Attached Low Density Residential zoning designation. In addition, the Community Renewal Plan for the Everett Smelter Redevelopment Area that has been drafted has been reviewed, and the minimum design standards for the development should be approved. INTRODUCTION Domestic Realty Company, 2903 B Hewitt Avenue, Everett, WA 98201 (Applicant) requested an area-wide rezone of property on the old Asarco smelter site, generally located on property whose east boundary is East Marine View Drive, north and west boundary is Broadway Avenue, and south boundary is the alley south of Butler Street, all in the City of Everett, Washington (subject property). The request is for an area-wide rezone of the subject property from an R-2, Single-Family Detached Medium Density Residential (R-2) zone to an R-1A, Single-Family Attached Low Density Residential (R-1A) zone. In addition, the Applicant has requested that the Everett City Council establish minimum design standards for a Community Renewal Plan that is applicable to these properties. A hearing was held before the Hearing Examiner of the City of Everett on July 22, 2004.
