WHEREAS, in addition to its powers as a housing authority under RCW 35.82, the <br /> Everett Housing Authority may need to exercise community renewal project powers in order to <br /> carry out its responsibilities effectively under said agreements and to promote the cleanup, <br /> rehabilitation, and redevelopment of the blighted area; <br /> WHEREAS, the Everett Housing Authority has indicated that it is willing to exercise <br /> such community renewal powers within the blighted area for the purposes stated herein; and <br /> WHEREAS,by letter of May, 18, 2004, Ecology has confirmed that the City of Everett <br /> will not obtain liability for its actions under said agreements in support of the Everett Housing <br /> Authority, and <br /> WHEREAS,the City of Everett and the Everett Housing Authority share a common <br /> community interest in facilitating the rehabilitation and redevelopment of the blighted area in <br /> order to protect human health and the environment,provide housing, rehabilitate the <br /> neighborhood, implement the City of Everett comprehensive plan, and otherwise address the <br /> adverse impacts of the existing blight as set forth in Resolution No. 5504 ; and <br /> WHEREAS,the Everett Housing Authority has exercised exemplary civic leadership in <br /> an effort to provide for rehabilitation and redevelopment of the area for the benefit of the City <br /> and its residents; and <br /> WHEREAS, for the reasons set forth above, the City Council determines that it is in the <br /> public interest to authorize the Everett Housing Authority to exercise the powers of a community <br /> renewal agency. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br /> CITY OF EVERETT <br /> Section 1: Pursuant to RCW 35.81.050(2) and 35.81.150, the City of Everett elects to have <br /> the powers set forth in RCW 35.81.150, and any other applicable provision of the state Community <br /> Renewal Law, exercised by the Everett Housing Authority acting as a community renewal agency, <br /> subject to the conditions set forth below. <br /> Section 2: The exercise of the powers by the Everett Housing Authority under this <br /> Resolution shall be limited to such area(s) of blight as may be specified in Resolution No. <br /> 5504 or any amendments to that resolution. <br /> Section 3: The Everett Housing Authority, acting in its capacity as a community renewal <br /> agency under this Resolution, is hereby authorized to prepare community renewal plans, <br /> projects, or programs as provided by RCW 35.81.150(2)(a)—(c) for the blighted area, for public <br /> review and for consideration by the City Council under the state Community Renewal Law. <br /> Section 4: The community renewal plan or project plan("Plan") shall be consistent with <br /> the City Comprehensive Plan, the integrated Final Cleanup Action Plan and Final Environmental <br /> Impact Statement for the upland area of the Asarco Smelter Site as amended("FCAP"), related <br /> Page 2 of 3 <br />
