South Slope Planting Plan Submitted by John Arendt dated 5/15/00 <br /> Based on the testimony and evidence submitted, the following findings of facts <br /> and conclusions are issued to support the Amended Order: <br /> FINDINGS OF FACT <br /> 1. On January 28, 2000, the Appellants were found to be in violation of the <br /> Everett Municipal Code (EMC) 19.37 and an Environmentally Sensitive <br /> Protective Covenant between the City and the Appellants on August 31, <br /> 1998. The Appellants were fined $500 for these violations, but the fine <br /> was to be suspended upon compliance with the Order. <br /> 2. The compliance with the Order included the Appellants submitting an <br /> approved planting plan for the south steep slope and stream buffer of <br /> Bigelow Creek (Condition #4). The Appellants were also required to <br /> implement the approved planting plan (Condition #5). The submittal of the <br /> planting plan and the implementation of the plan were to be completed by <br /> May 15, 2000 (Condition #7). <br /> 3. The planting plan was not submitted until May 15, 2000, and it was not <br /> approved by the City of Everett_ No work was done to implement the <br /> planting plan and bring the subject property into compliance_ <br /> 4. The Appellant contended to be confused with the Order of January 28, <br /> 2000. He submitted in the May 5, 2000, request for an extension that the <br /> Order requires the Appellant to trespass and plant on adjacent property <br />
