FINDINGS AND DECISION
OF THE HEARING EXAMINER OF THE
CITY OF EVERETT
IN THE MATTER OF THE APPEAL
OF JOHN A. & PAMELA E. ARENDT VIOLATION #93-99
2210 - 49th STREET SE, EVERETT
DECISION: The Appellants' appeal of a City of
Everett Code Compliance Violation
Citation is denied. The Appellants
shall comply with the conditions of
this Order as set forth at the end of
this document.
INTRODUCTION
On May 4, 1999, the City of Everett Department of Code Compliance issued an
amended Violation Citation against John A. and Pamela E. Arendt (Appellants)
for violation of the Everett Municipal Code (EMC) 19.3T0401. This ordinance
sets forth regulations relating to Environmental Sensitive Areas in the City of
Everett.
An appeal of the Violation Citation was filed, and a hearing was held before the
Hearing Examiner of the City of Everett on January 13, 2000. At the hearing the
following presented testimony and evidence:
John Arendt
2210 - 49th Street SE
Everett, WA 98203
Nicholas Matarangas
720 Olive Way, Suite 625
Seattle, WA 98101
John Lauffenberg
Wetland Resources, Inc.
9505 - 19th Avenue SE #106
Everett, WA 98208
' Throughout the scenario of continuances of the hearing of this Violation Citation, the City did not cite the
same ordinances as the controlling ordinance of this action. However, after a review of the evidence and
testimony presented at the public hearing, it is apparent that EMC 19.37.040 is the ordinance in question. It
will be the basis of the decision.
1
