FINDINGS AND DECISION <br /> OF THE HEARING EXAMINER OF THE <br /> CITY OF EVERETT <br /> IN THE MATTER OF THE APPEAL <br /> OF JOHN A. & PAMELA E. ARENDT VIOLATION #93-99 <br /> 2210 - 49th STREET SE, EVERETT <br /> DECISION: The Appellants' appeal of a City of <br /> Everett Code Compliance Violation <br /> Citation is denied. The Appellants <br /> shall comply with the conditions of <br /> this Order as set forth at the end of <br /> this document. <br /> INTRODUCTION <br /> On May 4, 1999, the City of Everett Department of Code Compliance issued an <br /> amended Violation Citation against John A. and Pamela E. Arendt (Appellants) <br /> for violation of the Everett Municipal Code (EMC) 19.3T0401. This ordinance <br /> sets forth regulations relating to Environmental Sensitive Areas in the City of <br /> Everett. <br /> An appeal of the Violation Citation was filed, and a hearing was held before the <br /> Hearing Examiner of the City of Everett on January 13, 2000. At the hearing the <br /> following presented testimony and evidence: <br /> John Arendt <br /> 2210 - 49th Street SE <br /> Everett, WA 98203 <br /> Nicholas Matarangas <br /> 720 Olive Way, Suite 625 <br /> Seattle, WA 98101 <br /> John Lauffenberg <br /> Wetland Resources, Inc. <br /> 9505 - 19th Avenue SE #106 <br /> Everett, WA 98208 <br /> ' Throughout the scenario of continuances of the hearing of this Violation Citation,the City did not cite the <br /> same ordinances as the controlling ordinance of this action. However,after a review of the evidence and <br /> testimony presented at the public hearing, it is apparent that EMC 19.37.040 is the ordinance in question. It <br /> will be the basis of the decision. <br /> 1 <br />
