RESOLUTION NO. A RESOLUTION for the proposed vacation of 39th Street, East of Smith Avenue and West of Burlington Northern Railway. WHEREAS, the owners of more than two-thirds of the front footage abutting the street, described as follows: BEGINNING at the intersection of the Easterly right of way line of the alley in Block 26, Plat of J.S. Sines Acre Tracts and the Northerly right of way line of 39th Street; THENCE, East along said Northerly right of way line of said 39th Street 215 feet, more or less, to intersect the Westerly line of the Burlington Northern Santa Fe Railroad right of way (AKA and platted as G.N.R.R. [Great Northern Rail Road]); THENCE, South 80 feet, more or less, along said West line of said BNSF RR right of way to intersect the Southerly right of way line of 39th Street; THENCE, West along said Southerly right of way line 215 feet, more or less, to the Easterly right of way line of the alley in Block 32 of said plat; THENCE, North along the Northerly projection of said Easterly right of way line of said alley to the point of intersection of the Easterly right of way line of the alley in said Block 26 and the Northerly right of way line of 39th Street, and the POINT of BEGINNING. and shown on the attached sketch, have petitioned for the vacation of said rights of way and ; WHEREAS, R.C.W. 35.79.010 provides that City Council shall, by resolution, fix a date for public hearing on said petition; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVERETT that a public hearing be set for May 26th, 2004 at 8:30a.m. in the City Council Chambers, Old City Hall Building, at 3002 Wetmore Avenue, to consider the proposed vacation of the rights-of-way as herein described.
