10 <br /> 13. SURVIVAL. <br /> The covenants, disclaimers,waivers and releases of the parties set forth in Sections 8,9, <br /> 10 and 11 of this Agreement shall survive the termination of this Agreement. <br /> 14. MODIFICATION/AMENDMENT. <br /> This Agreement may not be modified orally. Any amendment or modification of this <br /> Agreement must be made in writing with the same formalities as are required for execution of this <br /> Agreement. <br /> 15. NO THIRD PARTY RIGHTS <br /> Nothing contained in this Agreement is intended to, nor shall it be construed to, create <br /> any rights in any person or entity not a party thereto. <br /> 16.
