7 <br /> FILE COPS <br /> CITY OF EVERETT <br /> VIOLATIONS HEARING EXAMINER <br /> City of Everett, a Washington ) <br /> Municipal Corporation, ) Case No. 03-0950 <br /> ) <br /> Respondent, ) FINDINGS OF FACT, CONCLUSIONS <br /> vs. ) OF LAW AND ORDER OF THE HEARING <br /> ) EXAMINER <br /> Aaron Wood ) <br /> 2028 Adams Avenue ) <br /> Everett, Washington 98203 ) <br /> Appellant(s) ) <br /> This matter having come before the Violations Hearing Examiner on October l6, 2003, and the testimony of <br /> witnesses having been heard and all exhibits admitted into evidence having been considered, the Violations <br /> Hearing Examiner makes the following findings of fact and conclusions of law and order: <br /> Findings of Fact: <br /> l. Aaron Wood is the owner of record of the property located at 2028 Adams Avenue, Everett, <br /> Washington. <br /> 2. On June 30, 2003, July 3, 2003, July 9, 2003, August 1 1, 2003, August 18, 2003, and September <br /> 24, 2003, an engine block in the rear yard covered in morning glory vines, an open to trespass <br /> shed that is leaning with the siding falling off and is dilapidated was observed on the property at <br /> 2028 Adams Avenue, Everett, Washington. These same conditions were also observed on • <br /> October 13, 2003. <br /> 3. The shed is dilapidated to the extent to be considered a public nuisance and a dangerous building <br /> as a result of the structure leaning and siding falling off. Also the door is missing and the <br /> structure is easily accessible to trespass. <br /> 4. Aaron Wood was duly notified via certified mail and posting of property of these conditions on <br /> September 24, 2003, was given the opportunity to correct these conditions; and, has had adequate <br /> notice of the opportunity to appear at the hearing to appeal the city's allegations. Aaron Wood <br /> did appear at this hearing. <br /> 5. Aaron Wood testified that the foundation of the shed could be repaired by November l4, 2003. <br /> The City agreed that such action could occur. <br /> 37 <br />
