7 FILE COPS CITY OF EVERETT VIOLATIONS HEARING EXAMINER City of Everett, a Washington ) Municipal Corporation, ) Case No. 03-0950 ) Respondent, ) FINDINGS OF FACT, CONCLUSIONS vs. ) OF LAW AND ORDER OF THE HEARING ) EXAMINER Aaron Wood ) 2028 Adams Avenue ) Everett, Washington 98203 ) Appellant(s) ) This matter having come before the Violations Hearing Examiner on October l6, 2003, and the testimony of witnesses having been heard and all exhibits admitted into evidence having been considered, the Violations Hearing Examiner makes the following findings of fact and conclusions of law and order: Findings of Fact: l. Aaron Wood is the owner of record of the property located at 2028 Adams Avenue, Everett, Washington. 2. On June 30, 2003, July 3, 2003, July 9, 2003, August 1 1, 2003, August 18, 2003, and September 24, 2003, an engine block in the rear yard covered in morning glory vines, an open to trespass shed that is leaning with the siding falling off and is dilapidated was observed on the property at 2028 Adams Avenue, Everett, Washington. These same conditions were also observed on • October 13, 2003. 3. The shed is dilapidated to the extent to be considered a public nuisance and a dangerous building as a result of the structure leaning and siding falling off. Also the door is missing and the structure is easily accessible to trespass. 4. Aaron Wood was duly notified via certified mail and posting of property of these conditions on September 24, 2003, was given the opportunity to correct these conditions; and, has had adequate notice of the opportunity to appear at the hearing to appeal the city's allegations. Aaron Wood did appear at this hearing. 5. Aaron Wood testified that the foundation of the shed could be repaired by November l4, 2003. The City agreed that such action could occur. 37
