9 <br /> Section 4: The community renewal plan or project plan("Plan") shall be consistent with <br /> the City Comprehensive Plan,the integrated Final Cleanup Action Plan and Final Environmental <br /> Impact Statement for the upland area of the Asarco Smelter Site as amended("FCAP"),related <br /> Interim Action Report and Final Design Report, Site Restoration Plan and other plans and <br /> permits required to implement the FCAP in the blighted area. The Everett Housing Authority <br /> shall work with City in the development of the Plan,and following its preparation,the City shall <br /> cause the Plan to be considered for adoption, consistent with RCW 35.81. <br /> Section 5: At such time as the City Council has approved a community renewal plan or <br /> project plan, after notice and public hearing,in accordance with RCW 35.81.060,the Everett <br /> Housing Authority is thereafter authorized to exercise the remaining powers specified in RCW <br /> 35.81.150, subject to any conditions placed by the City Council on its approval of the community <br /> renewal plan or project plan. <br /> Section 6: The City of Everett reserves the right to determine at any time that a blighted <br /> area no longer exists;provided that: (a)such determination shall not prevent the implementation <br /> of any approved community renewal plan or project for the blighted area, as may be modified <br /> from time-to-time, and (b)the City has consulted with the Everett Housing Authority in order to <br /> avoid any adverse effects on the accomplishment of an applicable community renewal plan or <br /> project by removing such designation. <br /> Councilperson Introducing Resolution <br /> PASSED and APPROVED this day of <br /> ,2004. <br /> Council President <br /> El-IA City comm renewal agy reso.doc <br /> 3 <br /> Page 3 of 3 <br />
