5 5 <br /> permitting negotiations,the Contractor shall award the bid package to the low responsive <br /> responsible bidder. The Contractor may request and the Owner, in its sole discretion,may agree <br /> to changes in the bid package. The Contractor may then re-bid,but all time delays and costs <br /> associated with the re-bid shall be the responsibility of the Contractor. <br /> 4.6 If any subcontractor to whom a Bid Package has been awarded is unable to perform, the <br /> Contractor shall have theoption to re-bid or negotiate for the performance of the work or <br /> perform the work itself. Except as otherwise provided in this Article 4.the Contractor shall bear <br /> all risk and/or cost overruns occasioned by a subcontractor's inability to perform. <br /> 5. START AND COMPLETION <br /> The Contractor shall commence construction of the Project when all of the necessary permits <br /> have been issued and the Contractor has been given Notice to Proceed by the Owner. The <br /> Contractor may proceed with other Project Work that does not require the issuance of permits if <br /> given a limited notice to proceed in writing by the Owner. Such other Project Work includes,but <br /> is not limited to,procurement of long lead time materials,bidding of subcontracting packages, <br /> and initial mobilization or non-permit field work. In its sole discretion,the Owner may issue the <br /> written limited notice to proceed when satisfied that Contractor has complied with the insurance <br /> and bonding requirements of the Contract. The Contractor shall achieve Substantial Completion <br /> within 63O clenar days from Notice to Proceed.
