13 <br /> would tie the request for the Frauenholtz property to the legally non-conforming apartment <br /> building east of and adjacent to the subject property, and <br /> 2. The stated purpose for the action is to allow use of the subject property to enjoy an <br /> increased residential capacity and that this would require a rezone to B-1 or R-3, and <br /> 3. Further examination of criteria guiding such requests calls for findings of changed <br /> circumstances in the area, erroneous decision making leading to placing the present Single <br /> Family designation on the subject property, that pressure to convert nearby properties to similar <br /> use would not occur, that the action does not constitute special privilege and that the change <br /> would lead to an improved land use pattern in the area, none of which is found in this proposal, <br /> and <br /> 4. The Everett Planning Commission has recommended against the proposed <br /> Comprehensive Plan and rezone change and their desire to keep this parcel and other parcels in <br /> the area single family zoning, and <br /> 5. Nearby residents have testified they appreciate the single family character of the area and <br /> would not want to see it begin to convert over to higher density residential use. <br /> NOW, THEREFORE, THE EVERETT CITY COUNCIL RESOLVES THAT: <br /> On balance the criteria used to examine such requests, as well as testimony from affected and <br /> nearby property owners lead the Council to deny the request. The applicant has not made a <br /> compelling argument for a reason for the change and that circumstances have changes to justify a <br /> change at this time.
