5 <br /> WHEREAS, the City Council finds: <br /> 1. The purpose for the requested Comprehensive Plan land use map amendment <br /> and rezone is to join the subject area to the abutting commercial use to the north, which <br /> is also owned by the applicant, and <br /> 2. The need for the proposed Comprehensive Plan amendment and rezone is to <br /> allow the subject area to be used for expanded parking, and <br /> 3. To achieve the indicated land use change the City needs to amend the <br /> Comprehensive Plan Land Use map from Multiple Family (1.6) to Mixed Use <br /> Commercial — Multi Family (4.4) and Rezone the property from R-3 (Multi Family) to C-1 <br /> (General Commercial), as indicated on the attached map (Exhibit "A"), and <br /> 4. The subject site is adjacent to 4th Avenue West which is a busy corridor, <br /> neighbors to the east and south have indicated a desire to be screened not just by <br /> landscaping but also by a fence along the property line and there have been complaints <br /> about trash on the site and refuse placed on adjacent properties by tenants of the <br /> commercial operation under property ownership of Lee. Planning Commission has <br /> recommended certain steps be taken to alleviate these conditions. <br /> 5. The public health safety and welfare will be provided for by the proposal under <br /> existing development regulations of the City. <br /> 6. The proposed amendment to the land use map and rezone promotes the best <br /> long term interest of the Everett Community. <br /> NOW, THEREFORE, THE EVERETT CITY COUNCIL HEREIN RESOLVES TO: <br /> 1. Amend the Comprehensive Plan Land Use map in the subject area east of <br /> Highway 99 at 4th Avenue west from Multiple Family (1.6) to Mixed Use Commercial — <br /> Multi Family (4.4) and Rezone the property from R-3 (Multi Family) to C-1 (General <br /> Commercial), as indicated on the attached map (Exhibit "A") subject to certain <br /> conditions at or before the time of its initial improvement: <br /> a. The subject property will only be used in support of the existing business <br /> to the north. This means it can be used for parking, storm water <br /> detention, sanitary control etc, and <br /> b. The adjacent property to the east will be cleaned up by the removal of any <br /> refuse, metal drums etc. Such clean-up will be approved by the City Code <br /> enforcement office, and <br /> 133 <br /> - 2 - <br />
