• <br /> Planning Commission Minutes <br /> October 19, 2004 <br /> Approved • <br /> Commissioner Dutton called the meeting to order at 6:30 p.m. Other Commissioners <br /> attending were CJ Ebert, Clair Olivers, Michelle Trautman, Lyle Ryan, Carol Lorioux <br /> Loup, and David Simpson. <br /> City staff members present were Allan Giffen, Dave Koenig, Bob Larsen, and Kathy <br /> Davis of the Planning Department. <br /> Clair Olivers made a motion to approve the September 7, 2004 minutes. Michelle <br /> Trautman seconded the motion. <br /> Item #1: Workshop — Potential rezone and height change on Rucker Avenue from <br /> Everett Avenue to Pacific Avenue <br /> Bob Larsen stated that City staff had been asked to consider rezoning an area west of <br /> the downtown core on Rucker Avenue from Everett Avenue to Pacific Avenue from C-1 <br /> to B-3 and to change the height of buildings on the east side of Rucker Avenue from 80 <br /> feet to 150 feet. Mr. Larsen presented slides to the Commission that included the <br /> proposed rezone area in relation to the downtown core. Rezone options: 1) Rezone <br /> the eastern portion of Rucker Avenue, north and south of the current B-3 area to B-3 <br /> with 150 foot height and rezone the western side of Rucker Avenue over to the alley as <br /> B-3 but leave the current height at 80 feet which is currently allowed in C-1; or 2) to <br /> rezone the east side of Rucker to B-3 with the west side remaining C-1. In both options <br /> the height change from 80 feet to 150 feet would apply to the east side of Rucker <br /> Avenue and the west side would remain at 80 feet. <br /> Mr. Larsen stated that staff listed all the uses in the proposed rezone area to determine <br /> if any uses would become nonconforming if the B-3 zoning were approved. Staff did <br /> find three businesses located in the proposed rezone area that would not be permitted <br /> in the B-3 zone: an espresso stand, a storage unit facility, and a rental car facility. <br /> Through the rezone action, these uses would become nonconforming and would be <br /> allowed in their current locations. Dave Koenig presented a letter to the Commissioners <br /> requesting that the entire block be rezoned to B-3 with a 150' building height standard. <br /> Dave Koenig reviewed the rezone process: 1) 1St meeting introduced the proposed <br /> rezone so Planning Commission could provide some direction to staff regarding the <br /> rezone alternatives, 2) staff would notify property owners in and within 500 feet of the <br /> proposed rezone area, 3) Planning Commission workshop, and 4) Planning <br /> Commission public hearing. <br /> Commissioner Dutton asked why the 150' building height was only proposed for one <br /> side of Rucker. Mr. Giffen responded that the existing B-3 zone regulations have <br /> different height limits throughout the zone. Before 1990, there was unlimited building <br /> height anywhere in the B-3 zone. When the City adopted the 1990 Zoning Code, the <br />
