8 <br /> B. Penalties. <br /> 1. It is an infraction for any person to violate this section, to be punished by a <br /> fine of sixty-two dollars ($62.00). not including costs and assessments. • <br /> 2. Every person who violates this section a third or more time within a two- <br /> year period shall be guilty of a misdemeanor, punishable by a maximum <br /> possible ninety (90) days in jail and a fine of not less than two hundred <br /> fifty dollars ($250) nor more than one thousand dollars ($1,000). Two <br /> hundred fifty dollars of the fine shall not be suspended or deferred. but the <br /> court may authorize community service in lieu of all or part of the fine. <br /> Section 2: Section 1 (part) of Ordinance 1246-86, as amended by Section 1 of <br /> Ordinance 1571-89 (Everett Municipal Code 12.02.170),which reads as follows: <br /> Speed limit—No Wake Zone. <br /> A. There is designated a "No Wake Zone"which shall consist of the following: <br /> 1. All waters in Port Gardner Bay and the Snohomish River, lying easterly of <br /> Jetty Island and northerly to the two hundred block of West Marine View <br /> Drive and southerly to the mouth of the Snohomish River at No. 5T <br /> Navigation Buoy. <br /> 2. All waters northerly and easterly from the west span of the State Route <br /> 529 bridge, to the intersection of the Snohomish River and Interstate 5 <br /> bridge span. <br /> B. No vessel, motorboats or hovercraft shall be operated in the No Wake Zone in <br /> such a manner as to leave a visible and/or damaging wake. <br /> C.
