Navy Responsibilities <br /> Enforcement of City Ordinances, Codes and Policies <br /> Upon entering into a contract with Everett for water service,sewer service and OWTP <br /> service,NSE agrees to abide by and conform to Everett's water and sewer ordinances, <br /> codes,and policies.Additionally,the NSE must comply with State and Federal water, <br /> sewer,and industrial pretreatment related regulations when Everett is operating under <br /> those regulations/requirements.The NSE agrees to be subject to City enforcement <br /> actions if and when cited for violations of the aforementioned ordinances,codes, <br /> regulations,and policies. <br /> Environmental Compliance <br /> Although Everett will operate the water and wastewater systems,Everett was not <br /> responsible for construction and operations to-date. For some of the NSE system that <br /> Everett will operate,Everett will not fully responsible for all backup systems,e.g.some <br /> of the backup generators will still be under Navy operations. The City will be <br /> responsible for our actions,however for spills or environmental compliance situation <br /> beyond the City's control the Navy will be responsible. The City will and can provide <br /> notice to federal or state agencies for spills,however the Navy will retain the <br /> responsibility for any agency corrective actions and citations. <br /> Property Protection and Claims <br /> Property damage,beyond the control of the City,to any facility,structure,or asset <br /> within NSE due to failure or incident is not the responsibility of the City. <br /> Navy-Provided Service <br /> Everett's proposal assumes that the Navy will provide the following services: <br /> • OWTP Residuals: Navy will continue to provide the current level of OWTP <br /> residuals disposition as they do now,including residual solids, oil recycling, and any <br /> other aspects of residuals disposition that Everett may not be aware of at the time of <br /> the contract signing. <br /> • OWTP Transport of Bilge Water from ships to the risers: Navy will be <br /> responsible for transporting oily water between the ships and the oily water delivery <br /> piping systems connection points. <br /> • Forklift Truck Services:Navy will provide forklift truck services until such time as <br /> those services are no longer required by Everett. <br /> • On Base Communications hard wire: Navy will provide on-base communications <br /> hard wire for the purpose of transmitting signals to the City facilities. <br /> • Crane Services/Access to Utilidors: Navy shall provide crane services to Everett as <br /> needed for access. <br /> 62 <br /> S:\MSadIer\WORD\Navy\final docs\council Executive Summary.doc 2 5/2/2005 <br />
