<br /> IN C0�lSIDERATION of benefits to accrue to the Grantors herein, the
<br /> undersigned, DEAN ECHELBARGER, KENNETH A. HOVDE and GEORGE BARBER, fiereby
<br /> grant tn the CITY OF EVERETT, a municipal corporation, a permanent easemen[
<br /> for [he installation, operation and maintenance of a sanitary sewer pipeline,
<br /> over, under, across, through and below the following described proper[y, and
<br /> the further right to remove trees, bushes, undergrow[h and other obs[ructions
<br /> in[erfering with the location, construction and maintenance of said sanitary
<br /> sewer pipeline, together with the right of access [o [he easement at any time
<br /> for the stated purposes.
<br /> The permanent easement and right-of-a�ay hereby granted is iocated in
<br /> the Coun[y of Snohomish, State of Washington, and is more particularly described
<br /> as follows : •
<br /> That portion of the southwest quarter of the southeast quarter c`
<br /> Sec[ion 31 , Township 29 North, Range 5 East W.M. , described as
<br /> follows : Beginning at the northeast corner of Lot S, Cascade
<br /> Terrace Addition to E�erett, accordin9 to the plat thereof recorded
<br /> in Volume 12 of Plats, on page 41 , records of Snot�omish County,
<br /> , Washington; thence south, along the east line of ,aid I�ot 5, a
<br /> distance of 80.00 feet; [hence east, a distance of 10.00 Feet;
<br /> thence north, a distance of 33.�0 feet; thence N22°30'00"E, a
<br /> ' distance of 37•50 feet; thence 562°27'26"E, a disCance of 140. 10
<br /> feet to an intersection with the westerly margin of Evergreen Way,
<br /> said intersection being on the arc of a curve having a radius of
<br /> 5679.65 feet, from which intersection the radius point of said
<br /> curve bears N76�58' 12"W; thence northerly, along the westerly
<br /> margin of Evergreen Way and the arc of said curve, being a curve
<br /> to the left and consuming a central angle of 0°06' 15", an arc distance
<br /> of 10.33 feeC; thenr_z ribz°27'26"W, a distance of 145,72 feet; [hence
<br /> 589°10'30"W, a distance of 21 .69 feet to the Poin[ of Beginning.
<br /> The CITY OF EVERETT agrees [o restore to substantially the original
<br /> condition such improvements as are disturbed during the consCrucl:ion, mainCenance
<br /> and repair of said sanitary se�•+er pipeline, provided, [he Grantors , their suc-
<br /> cessors or assigns , shall net construct any permanent structure over, upon or
<br /> s�i [hin the permanent easement.
