Alsol I ave not seen any
SEPA Checklist for the service station.
•ecause the Evergreen Way Improvement Requirement has become an issueo
several developers are challenging the requirement. The attached letter
received today is a sample. The letter, from t4estern Sizzlin' Steak at
9910 Everqreen requests Council review.
m We may be in violation of State Law if we do not require the Zmnrovement
after having placed it as a SEPA requirement.
RECOhi[dENDATION
It is recommended that Council minutes of April 12 1978, be corrected to
reflect more clearly that Council specifically ordered the Improvement
and that Council President Carl Gipson write to the Steak House with that
information.
Or, that this issue be reviewed for further direction from Council.
Specifically, wiYh regard to the site conditions and in the interest of
fairness and exposure for new developers along Evergreen, it is recommended
that the Cycle Shop Frontier Bunk and the Steak Hnuse be required to
install the Street Improvement at this time,
CIS:is/S2
Attachment
CC I.h `4/I4/ ((
