Box 1769 <br />Cverett, WA 98206 <br />Su6ject: 7431 Evergreen 1Vay <br />Proposed C - 4'ash Addition <br />'�YE'.� � <br />�?� s <br />`- ,, <br />, .;--• ; <br />:`.. � - <br />Gentlemen: <br />We have received your subJect letter of A1ay 13, 1982, and offer the following <br />comments 3n an effert to clarify tlie City's position regarding the proposed <br />development. <br />In order to reduce trafiic hazards generally associated with the interface <br />between private proFerty and the public rights-of-way, Clty Ordinance 555-78, as <br />amended by 655-80 ar.d 793-51, requires that certain minirnum puUlic right-of- <br />uay improvements be performed in wnjunction with any ne�. constructlon on <br />private property lSection 2A). in sorne cases, in order to accomplish the right- <br />of-way improvements necessary to accomodate certain private property <br />improvements, it is alsn necessary ttiat additlonal rignt of �»ay be deeded to the <br />City to complete the required street Improvemenis in accordance u�ith City <br />Sta�dards (Section 2C). <br />Applying Ordinance 555-78 to the subject proposal, the Clty I�ad a joini meeting <br />with tne appiicant, George �. 1T'eiman, and his engineer, Don R. Strcng, on 4-26- <br />82, to review the appropriate improvements to the rights-of-way of 75th Street <br />and Evergrecn Way abutting the development site. After extensive plan revie�v, <br />it was determined that requiring frontage improvements would result ir� <br />extensive relocation of signalization, po�ver, etc., as �velt as generating traffic <br />safety concerns as a result of alignment pro6lems. Therefore, tt;e City E��gineer <br />determined that Sections 2.A.2 and 2.A.4 0: the a6ove noted ordinance were <br />applicable �nd the Improvements should be constructec! in a more compcehensive <br />intersection clesign. L.I.D. Covenants would M obtained for a future Local <br />Improvement District to construct the street and necessary appurtenances. <br />The ultimate design and improvements to the northeast intersection area of 75th <br />Strect and Evergreen u�ay wiii require a right turn lane, curb, gutter, and <br />siden�ali<. The addItional rights-of-way on the north side ef 75th Street necessary <br />to construct these Improvements is ten (10) feet. In conslueration that the <br />proposed car wasl; facillty will gcnerate additional vehicle and pedestrian traific <br />and �� ill contribute to the nced for the ultimate street lmprovements in order to <br />pro:ide smoother and safer egress and in�ress which forms the basis for Sec:ion <br />2C of the .:bove referenced ordinance, ths City will require dedication oi ten UO) <br />feet of right-of-way on 75th Street abutting your cJient's site as a condition of <br />develnpment. <br />
