In order to reduce traffic hazards generally associated with the interface <br />between private property and the public rights-of-way, City Ordinance 555- <br />78, as amended by 655-80 and 793-81, requires that certain minimum public <br />right-of-way improvements be performed in conjunction with any new <br />construction on private property (Section 2A). In some cases, in order to <br />accomplish the right-of-way improvements necessary to accomodate certain <br />private property improvements, it is also necessary that additiu�,al right of <br />way be deeded co th^ City to complete the required street improvements in <br />accordance with Ciiy Standards (Section 2C). <br />Applying Ordinance 555-78 to tlie subject proposal, the City had a joint <br />meeting with the applicant, George D. Welman, and his engineer, Don R. <br />Strong to review the appropriate improvements to the rights-of-way of 75th <br />Street and Evergreen Way abutting the development site. After extensive <br />plan review, it was determined that requiring frontage improvements would <br />result in extensive relocation of signalization, power, etc., as well as <br />generating traffic safety concerns as a result of alignment problems. <br />Therefore,the City Engineer determined that Sections 2.A.2 and 2.A.4 of the <br />above noted ordinance were applicable and the improvements should be <br />constructed in a more comprehensive intersection design. L.[.D. Covenants <br />would be obtained for a future Local Improvement District to construct the <br />street and necessary appurtenances. <br />The ultimate design and improvements to the northeast intersection area of <br />75th Street and Evergreen Way will require a right turn lane, curb, gutter, <br />and sidewalk. The additional rights-of-way on the north side of 75th Street <br />necessary to construct these improvements is ten (10) feet. In consideration <br />that the proposed car wash facility will generate additional vehicle and <br />pedestrian traffic and will conci;bute to the need for the uitimate street <br />improvements in order to provide smoother and safer egress and ingress which <br />forms the basis for Section 2C of the abov� referenced ordinance, the City <br />requires dedication of ten (10) feet of right-of-�vay on 75th St. abutting the <br />site as a condition of development. <br />
