The deadline for application was June lst. <br /> Dtike Spano and Arnie Kegal have been aware o£ this provision and date since <br /> at least as early as February 26th. Some latitude for argument might have <br /> been availabie for us to try to accomodate them if this was June lOth, or if <br /> a partial apnlication had been made on time or son�e reasonable basis for us <br /> to part from the legislation set in t}ie LID Ordinance. D±aking this exception <br /> withovt a very strong case being made for the excention �vill take away our <br /> ability to deny permits requested August lOth, or September or next year <br /> without opening up the th:ee million dollar project to litigation and causing <br /> the project to Ue delayed. <br /> I did talk to Arnie K4ga1 as reported to you; back in February and again in <br /> March �ahen he �vas representiiig several property owners who thought they <br /> {at that time) ivanted to do their ozon .improvements. D9y position was at that <br /> time (and still is) that pieceme�l improcements ivere allowed by the ordinance <br /> but that it was not the most desirable approach. That we would work with the <br /> appli.cants o£ the improvements to assist Yhem in their application preparation <br /> by providing as much of the LID design information as ivas available. And <br /> ',:h:�t ive always try to be as flexiUle as possible to accomodate the needs o£ the <br /> property owners. Since those early meetings neither Kegal or Spano has talked <br /> to me or tu Gary Powell or indicated in any way that they intended to pursue <br /> construction of street improvements. My assumption over these last several <br /> months nas been that they changed their minds. I did not tell him, as <br /> reported to you, that he could ,imply ignore the LID Ordinance deadlire. Our <br /> sp�cial counsel hirad £or this LID has recommended that �ve do not accept the <br /> permit.
