The occurrence of any one or more of the following shall <br /> constitate an Event ofDefault hereunder: <br /> , (a) The failure to make any payment required under the Note,this Deed <br /> of Trust,or any of the other Loan Documents wHen due, including,without limitation, <br /> payments of taxes,utilities, liens and insurance premiums. <br /> ' (b) The failure to perform any other covenant,agraement or obligation <br /> � under this Deed of Trust or any of the other Loan Documents,if not cured within the Hme <br /> Iallowed. No���ritten demand and no curc period shall be required if,during the prior <br /> twelve(1 Z)months,Lrnder has already sent a written demand to Botrower concerning <br /> default in the same obligation. <br /> (c) The occurrence of an Evant of Default under any of the other Loan <br /> Documents. <br /> (d) Borrower or any guarantor or any trustee of Bo:rower or any <br /> guarantor files a petirion in bankruptcy for an arrangement,reorganization cr any other form <br /> of debtor relief; or such a petition is filed against Bo[rower or any guarantor or any trustee <br /> of Borrower or any guarantor and the petition is not dismissed within forty-five(45)days <br /> after filing. <br /> (e) A decrec or order is cntered for the appointrnent of a trustee, receiver <br /> or liquidator for Bocrower or any guarantor or Bortower's or any guazantor's property, and <br /> such decree or order is not vacated within forty-five(45)days aRer the date of entry. <br /> (� Borrower or any guarantor commences any proceeding for dissolution <br /> or liquidation;ot any such proceeding is commenced against Borrower or any gua�-antor and <br /> the proceeding is not dismissed within forty-five(45)days after the date of commencement. <br /> (g) Borrower or any guarantor makes an assignment for the benefit of its <br /> creditors,or admits in writing its inability to pay its debts generally as they become due. <br /> (h) There is an attachment, execution or other judicial seizure of any <br /> 18 <br /> 9806UI09 � 4 <br />
