the citation, granting any and all relief to which the city is entitled <br />under this chapter. <br />aE. An "emergency" means a situation which in the opinion of a code <br />compliance officer requires immediate action to prevent or eliminate <br />an immediate threat to the health or safety of persons or property. <br />Notwithstanding any provision in this chapter, when a violation <br />citation is issued in the case of an emergency, immediate action shall <br />be required by the person(s) to whom the violation citation is issued. <br />No action shall be stayed pending the filing of an appeal. If the city <br />does not obtain immediate action by the responsible person upon <br />issuance of the violation citation, the city is authorized to immediately <br />abate the violation itself or as otherwise provided herein. <br />Notwithstanding the exercise of emergency authority, the city is <br />entitled to collect its cost of abatement, assess penalties and take all <br />actions provided in this chapter. <br />Section 3: Third Party Liability. It is expressly the purpose of this ordinance to <br />provide for and promote the health, safety, and welfare of the general public and not to <br />create or otherwise establish or designate any particular class or group of persons who <br />will or should be especially protected or benefited by the terms of this ordinance nor <br />create any duty for the City. Nothing contained in this ordinance is intended nor shall be <br />construed to create or form the basis of any liability on the part of the City, o its officers, <br />employees or agents, for any injury or damage resulting from any action or inaction on <br />the part of the City, its offices, employees or agents. <br />Section 4: Severability. The City Council hereby declares that should any section, <br />paragraph, sentence, clause or phrase of this ordinance be declared invalid for any <br />reason, it is the intent of the City Council that it would have passed all portions of this <br />ordiance independent of the elimination herefrom of any such portion as may be declared <br />invalid. <br />Section 5: Savings. Nothing in this ordinance shall be construed as abating any official <br />action of the City now pending under or by virtue of any of the ordinances herein <br />amended by the adoption of this ordinance or as waiving any right of the City under the <br />policies, provisions and regulations amended by the adoption of this ordinance. <br />Section 6: Corrections. The City Clerk and the codifiers of this ordinance are <br />authorized to make necessary corrections to this ordinance including, but not limited to, <br />the correction of scrivener's/clerical errors, references, ordinance numbering, <br />section/subsection numbers and any references thereto. <br />RAY STEPHANSON, MAYOR <br />ATTEST: <br />11 <br />113 <br />
