Project: <br />Change Order no. <br />Change Order Effective Date: <br />Exhibit A—Description of Changed Work <br />The purpose of change order #2 is to add 130 calendar days to the contract time. No additional dollars are <br />being appropriated by this change order #2. The contractor agrees that by adding 130 calendar days to the <br />contract time the contractor will not seek additional compensation from the owner for any reason. <br />Likewise the City of Everett will not pursue issuance of liquidated damages due to the late physical <br />completion of the project. <br />Justification for added time to the contract: <br />During the facility testing and startup phase of the project, significant problems with motor to flywheel <br />bearings & coupling developed, causing bearings to overheat and be destroyed. The supplier removed and <br />took back to their east coast production facility the various parts for visual inspection and testing and <br />evaluation. Reassembly of the removed parts with new bearings was then done and further facility testing <br />and facility startup continued. A grease flinging issue then developed, which eventually was resolved. As <br />part of the resolution to the above issues a revised warranty was written and agreed upon by both parties. <br />The duration and subsequent resolution of the damaged bearings and grease flinging issues and agreement <br />to the verbiage in the revised warranty took a good deal of time. The 130 calendar days being added to this <br />contract is to cover this addition time. <br />Change order #1 extended the contract completion date to October 25, 2004. On September 21, 2004 the <br />City suspended contract time, (with 35 calendar days remaining in contract time), for the arrival and <br />installation of a new recirculation valve, FCV-8050 the City of Everett had requested. This valve was <br />installed on Nov. 29, 2004 and contract time restarted during the facility testing and project startup phase. <br />The project was considered physically completed on Wednesday, May 11, 2005. There are 165 calendar <br />days between May 11, 2005 and November 29, 2004. Subtracting the 35 calendars days during the contract <br />time suspension gives 130 calendars days to be added to the contract time by this change order #2. <br />Exhibit A <br />Page 3 of 3 <br />
