on <br />RESOLUTION NO. <br />A RESOLUTION of the City Council of the City of Everett, initiating and <br />expressing intent to disestablish the existing downtown Business <br />Improvement Area (BIA), and establish a new BIA pursuant to Chapter <br />35.87A RCW, and setting a public hearing before the City Council on the 29th <br />day of June, 2005, at 8:30 A.M. <br />WHEREAS, a BIA has existed and operated in City of Everett (City) since 1995 pursuant to <br />Chapter 35.87A RCW; and <br />WHEREAS, the downtown area of the City has changed by the addition of new businesses, <br />residential properties and condominiums and by the addition of the Everett Events Center on <br />Hewitt Avenue, thus enjoying additional business revenue and visitors to the downtown area <br />especially along Hewitt Avenue; and <br />WHEREAS, as a consequence of such changes in the downtown area there is a need to establish <br />a new BIA with different boundaries and the method used in calculating the assessments against <br />the properties in the BIA; and <br />WHEREAS, the City engaged the services of a consultant, expert in the affairs of downtown <br />business improvement areas of districts, who is in agreement that there is a need to reconfigure <br />both the boundaries of the BIA and the method used in calculating the assessments against the <br />properties in the BIA and to use assessed valuation as well as front footages as an basis for <br />assessments; and <br />WHEREAS, the most expeditious way to accomplish the reconfiguration of boundaries and <br />assessment method is to terminate the existing BIA and substitute a new reconfigured BIA in its <br />place, incorporating both the existing boundaries and the new boundaries along Hewitt Avenue; <br />and <br />WHEREAS, the City Council is willing to initiate and declare its intentions to disestablish such <br />BIA and set a time for public hearing thereon, all as herein below more specifically set forth; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />EVERETT: <br />Section 1. Pursuant to Chapter 35.87A RCW, it is the intention of the Everett City Council <br />to disestablish, terminate and dissolve the existing BIA established by Resolutions No. 4149 and <br />4151 and Ordinance No. 2097-95 in 1995 effective the effective date of the establishment of a <br />new BIA pursuant to Council actions to be taken June 29, 2005 or thereafter as may be <br />determined by Council as was created by Council in 1995 with the following described <br />boundaries: <br />
