9 <br />2. This evidence and all other evidence in the legislative record for this ordinance <br />support the conclusion that regulation of adult retail businesses by separating them from <br />sensitive uses such as schools, parks, residential zones and places of worship, and <br />separation of such businesses from each other, will both diminish the adverse secondary <br />effects and improve the quality of living within the City; and <br />3. The distribution of adult-oriented merchandise, including printed and <br />photographic materials, is protected by the constitutions of the United States and the State <br />of Washington, and that this ordinance is intended to protect such rights while addressing <br />the adverse impacts of establishments that distribute such merchandise; <br />NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br />Section 1. An adult retail business shall not be located or maintained within two <br />hundred fifty feet, measured from the nearest property line of the adult <br />retail use establishment to the nearest properly line of any of the following <br />uses or zones located inside or outside of the City of Everett: <br />1. public library; <br />2. public playground or park; <br />3. public or private school and its grounds, from kindergarten to <br />twelfth grade; <br />4. nursery school or day care center; <br />5. church, temple, mosque, synagogue, or other place of religious <br />90 <br />
