.` 4 . pUBL/C L�YOI� � <br /> , <br /> MEMORANDUM <br /> TO: FRANK ANDERSON COUNCIL PRESIDENT . <br /> FROM: MARIAN DENT, HriUSING INSPECTOR <br /> DA'TE: September 26, 1996 <br /> S�; 8830 Evergreen Way demolition completed. <br /> After submitting this project for placement on the October 2nd Council Agenda, <br /> it was advised by Jim Iles, Assistant Ciry Attomey, that $2,000 in addition ro <br /> the usual 5% retainer be withheld from the contract payment to the contractor, <br /> Horizon Trucking and Excavating. <br /> The reason for this action is due to issues regarding asbestos on the project. <br /> The Puget SounH Air Pollution Control Agency (PSAPCA) issued a Notice of <br /> Violation with the City of Everett being one of several named on the Notice. <br /> On September 17, 1996, Jun Iles, Tim Tyler, Building Official and myself inet <br /> with personnel from PSAPCA regarding the issues. <br /> After reviewing all the steps the City took to ensure compliance with all <br /> asbestos removal regulations, we were advised that [he City would receive a <br /> letter of closure on the matter. However, the Contractor may be fined <br /> approximately $2,000. <br /> Since then, it was advised that we withhold the addi:ional $2,000, which is <br /> allowed pursuant to Sec. 22 of the contract. <br /> These funds, along with the 5% usual retainage, would not be released until all <br /> the PSAPCA issues are resolved. <br /> Attached is an Agenda Item Cover Sheet with updated information to replace <br /> the one originally submitted. <br /> md <br /> 8 CITY OF EVERETf• 3200 Cedar Street• Everett,WP.98201 • (206) 259-8800 • Fax (206) 259-8856 <br />
