CITY OI' FV�RETT - BOARD OP' ADJUSTM�NT <br />ORDER <br />WHEREAS, hereCoCore, Chere was filed with Hie City oC �verett Planning <br />Department on November 19, 1971, an application for a variance of Sect.ion <br />No. 270 of Everett City Code No. 15. 04 by D, I-I, Maxfield, 3406 Federal for <br />permission to locate an accessory building to within two (2) feel four (�'�) inches <br />oi the side property line. Thereby waiving the minimum requirement of a <br />six (6) foot side yard setback, on the Collowing describ�d property: <br />Lots 32 and 33, Block 829, Plat of Everett <br />Div. "H" (3406 Federal), <br />and, <br />WHEREAS, December 6, 1971 was fixed as the date of hearing on said <br />application and proper notice having been given as required by law <br />and, <br />WHEREAS, a public hearing was held on said date and the Board of <br />Adjustment� after reviewing all testimony, made the findings that; <br />1 <br />2 <br />3. <br />The accessory building was erected in violation of �verett City <br />Code 15.04.270 <br />The location of the building obstructs the view of an abutting <br />property owner. <br />There is no undue hardship on Mr. Maxfield. <br />NOW, THEREFORE, based on the foregoing findings: <br />BE IT ORDERED BY THE CITY OF EVERETT BOARD OF ADJUSTMENT <br />that said application be DENIED; with the following stipulations to require <br />the moving of the accessory building to comply with tlie required six (6) foot <br />side yard setback and allow a period of six (6) months, or unLil June 6, 1972, <br />to move the accessory building. <br />and, <br />BE IT FINALLY ORDERED that a copy of this written order be transmitted <br />to the applicant for their information. <br />DATF OF ACTION: December 6, 1q71. <br />0 <br />. �� ���--.� <br />�r��� <br />Reid H.
