r <br />N <br />BOARD OF ADJUSTMENT <br />FINDINGS, CONCLUSIONS AND ORDER <br />(Variance i22-85) <br />October 101 1985 <br />NmMo <br />OCT 15 1985 <br />........................... <br />CITY OF EVERETT <br />Putgc Works Dept. <br />Based upon the written request for a variance from the City's zoning) <br />code, specifically 19.14.0509 made by John Clairborne at 3416 Federal Avenue,I <br />hereinafter referred to as "Applicant," the Board of Adjustment, following a <br />public hearing on said application held on October 7, 1985, and further havingi <br />i <br />reviewed all testimony, makes the following Findings, Conclusions, and Order: <br />FINDINGS AND CONCLUSIONS: <br />1. That there have been exceptional or extraordinary circumstances on <br />conditions applying to the subject property or as to the intended use <br />thereof that do nOt apply generally to other properties in the same) <br />vicinity or zone. <br />Finding: The lot is 75' X 120, and is located in the R-1 zone. The <br />existing house sets 7' from the rear property line. The applicant's <br />request is to add one story to the house and carry the building line to <br />the south. <br />Conclusion: The variance is consistent with other properties. <br />2. That such variance is necessary for the preservation and enjoyment of a <br />substantial property right of the appellant possessed oy the owners of <br />other propertias in the same vicinity or zone. <br />Finding: Most dwellings in the area have a setback similar to the one <br />proposed. <br />Conclusion: The variance would allow a property right enjoyed by other <br />property owners. <br />3. That the authorization of such variance will not be materially <br />detrimental to the public welf4e or injurious to property in the <br />vicinity or zone in which the property is located. <br />Finding: The house is a two-story; the building is not being enlarged <br />to the effect that it might block the view. <br />Conclusion: The additions would not be injurious to property in the <br />area. <br />4. That the granting of such variance will not adversely affect the' <br />Comprehensive General Plan. <br />Finding: The Comprehensive Plan shows this area as Single Family) <br />Residence. <br />Conclusion: This variance will not affect the Comprehensive Plan. <br />
