AND, WHEREAS, the Everett City Council concurred with the Planning <br />Commissibn decision at its regular Council meeting February 27, 1980, <br />NOW, THEREFORE, based on the foregoing findings: <br />BE IT ORDERED THAT said application BE GRANTED with the following stipulations: <br />1. That if the structure is to be constructed on slopes greater than <br />15%, the applicant shall comply with all requirements of the Steep <br />Slope Ordinance. <br />2. That a detailed permanent drainage plan and temporary erosion control <br />plan be submitted prior to commencement of site preparation. <br />3. Additional right of way shall be provided on 46th Street from <br />Federal to the west to maintain a 50 foot width. (The current <br />width of 46th tapers from approximately 50 feet, 900 feet west <br />of Federal to approximately 25 feet at its intersection with <br />Federal.) <br />4. A detailed site plan showing parking layout, landscaping, driveways, <br />storm drainage, right of way improvements, and sewer improvements <br />shall be submitted to Public Works Department prior to issuing any <br />permits. <br />5.' A fire hydrant is required within 200 feet of the proposed structure. <br />, <br />6. All site improvements, including landscaping, shall conform with the <br />site plan submitted October 10, 1979, or be subject to additional <br />Planning Commission and City Council review. <br />7. Construction of the office/classroom shall be underway by <br />March 1, 1981 or be subject to Planning Commission and <br />City Council review. <br />S. Any use proposed for the office space at the 7,uther Child <br />Center must be permitted by the Special Property Use section <br />of the Zoning Code (19.56.010 C 2) which limits the office uses <br />generally to the following: . . charitable organizations, <br />nonprofit service groups, juvenile care and treatment centers <br />and other similar uses which provide social, health and welfare <br />services for citizens". <br />9. The Luther Child Center must pay a sewer interceptor fee as deter- <br />mined by the Public Works Department. <br />AND, BE IT FINALLY ORDERED that a copy of this written order be <br />transmitted to the applicant for their information. <br />Date: February 27, 1980 <br />Dennis L.
