� <br />Cl'fY Ol' EVERETT <br />1'LANl�'ING DIIi�:C'I'OR DECISION <br />Review Process II N0;'-013 <br />November 9, 2007 <br />The City of L-:verett Planning Director grants approval �f a request by Russ Riegger to replace a <br />396 square foot, noncaiforming detached gar�ge with a 660 syuare foot garage with a maxim�m <br />height of 20 1'eet at 110 Fern Road with iLe following conditions: <br />1. Any change to tl'ie design and/or roof pitch requires Plamiing Director approval. The portion <br />oY the garage �a�ithin 1'ive f'eet of thc lot lines must not exceed 15 feet in heigh[. <br />2. Roofrop drainage from the new geu�age must be routed so as not to impac[ the adjoining <br />properties. <br />3. A covenant acctoptable to die Ciry Anorney's office shall be recorded on the title to the <br />properry stating that dte properry owi�er acknowledees the requirements of EMC 19.07.020, and <br />stating that the use o1' any accessory su•uctm�e is limited to accessory activities permitted by the zone <br />in which tl�e properry is loc�ted, and tl�ai �he �ccessory building shall not be converted to living <br />area or used for any purposes which arc nut in Cull compliance �vith zoning and building code <br />requirements. <br />�l. Tlte garage's siding and roofing muterial must b� compatihle wittt the existing dwelling. <br />Chapter 7 of tl�e Everett Municipal Code (GA4C) states that in making a determination, the Planning <br />Direc[or may look at :;uch 1'actors as ��ie�v obstruction, aesthetic impact on surrounding properties, <br />and impact on neighborhood character. <br />The Planning Director approved the ne��� garage based on the following: <br />'1'he proposed 20-foo� [all, deludied garage ���ill replace an existing one story detached garage that <br />does not meet die five-Yoot re�r xnd side se[hacks. 1'he garage was certified as having <br />nonconf'orming setbucl:s from d�e soudi and east lot lines under NCB f107-022. The garage has no <br />setback from the sou�h lot line und is setback LS feet from the east lot line.
