January 22, 1341
Paul ldiddleton
N,iddleton Painting
5609 Fleming Street
Everett, t4A 98203
RE: leetin ccnditions of Nonconforrina
granted on April 6, 1488, to operate a
establishment in a residential zone.
Dear Mr. Middleton:
L'se Permit r20,
commrcial
This letter is a follow up to our phvne conversation on
January 14, 1991. During that conversation, we discussed
problems you have encountered in making a good faith effort
to meet the conditions of your Nonconforming Use Permit. In
an effort to reach a solution, we explored a feasible
alternative a.> outlined below.
As you know, in order to satisfy the conditions of approval
of your Permit, it is necessary to provide a landscaping
"screen," including grass, along your street frontage as
well as paving and striping of the parking lot. Storm water
control will be a part of the parking lot design.
G Gr
everett
..i : MM1.L . :E'J6765
!VCSr.TT.Y:ASNn.GIOY
FE7G1
The problem has been in disposing of anticipated Storm water
runoff from the parking area. To date no easement access for
a storm water line from the site to the storm water trunk
line in Evergreen Way has been found, nor does it appear
that such easement will be forthcoming. Until a method of
disposal of the storm water is found, paving and landscaping
is not possible.
Tn light of the time that has elapsed in trying to obtain
easements and in fairness to nearby residents who have
legitimate expectations to see improvements made, the City
Engineer has determined that it may be possible for you to
provide a rain-water infiltration system. It is anticipated
this could be accomplished by a gravel filled infiltration
vault or similar means.
This new provision is contingent upon receipt of a favorable
soils and infiltration system design prepared by a licensed
engineer. The desir and accompanying calculations need to
show that tfire-soils.on site will provide adequate absorption
of a 25 year torm event.
i
