The original design with the stairs and the <br />sides of the building would have been a more desirable situation (see <br />enclosures), but since the plan checker directed the builder to not place the <br />entry stairs on the side and the inspectors were fully aware of the height of <br />the stairs and deck during construction and allowed the builder to proceed, it <br />would not be appropriate at this time to require that a variance be obtained. <br />In addition, it has been a policy to allow decks to extend into the front yard <br />setback, even if they are higher than 8 feet. A literal interpretation of the <br />zoning code would not permit decks above the second level to project into the <br />front yard.
