ESTABLISHMENT OF EASEMENT
<br />Whereas Georqe M. Neffner, a sinqle person is the owner of the
<br />following described property:
<br />Lot 4 of Short Plat 86-090-A under Auditor�s File No. 8711300429,
<br />being a portion of Lots 46 and 47, Plat of Beverly Hills Division
<br />No. 3, according to the plat thereof recorded in Volume l0 of
<br />Plats, page 83, records of Snoriomish county, Washinqton, Situate
<br />in the County of Snohomish, State of Washington;
<br />and whereas Gary Harstad and Lorna R. Harstad, husband and wife
<br />are owners of
<br />Tract B of Short Plat No. SP 1202-11-81 as filed under Auditor's
<br />File No. 8112080161, being a portion of Lot 48, Plat of Beverly
<br />Hills Division No. 3, according to the plat thereof recorded in
<br />Volume 10 of Plats, page 83, records of Snohomish County,
<br />Washington, situate in the City of Everett, County of Snohomish,
<br />State of Washington.
<br />And whereas Gary and Lorna R. Harstad are desirous to establish
<br />an easemPnt f'or utilities underground within the East 10 feet of
<br />said Neffner property except any portion lying within the North
<br />36.01 feet thereof, which easement will be appurtenant to said
<br />Harstad property.
<br />Now thereof, it is agreed between the parties that an easement is
<br />hereby grantc•d to and conveyed to Gary and Lorna R. Harstad,
<br />husband and wife, their heirs, successors and assigns, said
<br />easemant is also hereby reserve3 for, granted and conveyed to�
<br />Public Utility District No. 1 of Snohomish County, General
<br />Telephone Company of the Northwest, Inc., Cable Television
<br />Company and Washington Natural Gas Company, their respective
<br />successors and assigns in which to install, lay, construct,
<br />renew, o�5�rate and maintain underground conduits, cables and
<br />wires with necessary facilities and other equipment for the
<br />purpose of serving this subdivision and other property with
<br />electric and telephone service, and natural qas service.
<br />No lines or wfres for the transmission of electric current or for
<br />telephone use, cable television, fire or police siqnals, or other
<br />purposes shall be placed or permitted to be placed upon any lot
<br />outside the buildings thereon unless the same shall be
<br />underqround.
