In recent years however, the City has haen installing se�ver laterals Trom the main to the ekisting property line when (1) the se�ver main is a bond sewer, and (2) it can reasonably be assumed that not installing the lateral when the sewer main �vas uistalled, was an oversight. This devia- tion from tlie Sewer Code was based on the City Altorney's opinion that the original intent of the bond sewer construction tivas to pro- vide sewer service to the property line as it existed at the time of construction. In your part.icui:r casc, a sewer lateral from the main to the property line was installed when the sewer main �vas constructed. Thus the intent of the bond se�ver construction was satisfied. The issue of extending the existing sewer lateral to the new pro- perty line is another problem �chich, from the Sewer Department's standpoint, is unre7ated to our policy of providing new sewer laterals on bond sewers. Since by City ordinance, the subject building should have been connected within 30 da} s after Ge�vers were available, and since City records indicate that the buiiding probably was connecCed to the sewers, I cannot see how the City could have foreseen or prevented the situation that exists no�v. It is therefore our position that you are responsible for inalcing the connection from 6728 and 6730 Fleming Street to the se�ver lateral.
