In that letter, we <br /> indicated that a building permit would not be issued on Lot 1 of the preliminary plat because the <br /> conditions of preliminary approval have not been met. In spite of code restrictions which requ've <br /> compliance with preliminary approval prior to development of the lot(s), you have sought to obtain a <br /> building permit for consVucbon of a residence on Lot 1. (Lot 1 is an ezistmg lot that is being <br /> modified as a result of the plat.) <br /> The City recommends that you either wait undl final plat approval has been granted for the <br /> subdiv�s�on, or withdraw the preliminary plat applicadon. Notwithstanding the above concerns, there <br /> remains a potential for a conflict to cecur between constructing a residence in the proposed location <br /> on Lot I and compliance with the condidons of preliminary plat approval. The fact that you were not <br /> party to the subdivision application also raises a concern over yow status as an applicant in the <br /> subdrvis�on. <br /> In spite of the above, the City would consider issuing a building permit for construction of a residence <br /> on Lot 1, if you provide the City with a written dceument signed by yourself and the owners and/or <br /> developers of the plat addressing the following: <br /> 1. Acknowledging that the City has recommended against issuance of a permit at this time due to <br /> the fact that preliminary plat approval has already been granted for the property; condidons of <br /> preliminary plat approval turve not been met; and there is the possibility of changes to the lot <br /> dimensions and location of the street and utilites due to the status of the property. You must <br /> agree to accept all risks of building under these wndidons; <br /> 2. A statement by the owners or representatives of all real property involved in the Spinnaker <br /> Pointe prelimmary subdivision (City of Everett Subdivision #7-93) that they understand the <br /> risks and have no objection to the issuance of a building permit for a single-family residence <br /> on Lot 1 of the preliminary plat, and recogniuon that comptiance with �hese conditions is the <br /> developer's responsibility. <br /> 3.
