building, and a variance would not be required to add the
second floor since it would not be making it more noncon-
forming.
b. Conclusion_ Granting this variance will not be material-
ly detrimental to the property in the area or to the City
as a whole. In fact, it will improve the area, since a
dilapidated building will be improved and refurbished.
Criterion No. 3:
That the variance will only grant the subject property the same
general rights enjoyed by other property in the same area and
zone as the subject property.
a. Findinas: There area other homes in this area that do not
meet rear setback. An example is the home directly tu the
south at 1709 Fulton.
b. Conclusions: Granting this variance will allow a, general
right enjoyed by other property in the same area and zone.
Criterion No. 4:
1 That the variance is the minimum necessary to allow the subject
property the general rights described in Criterion 3.
a. Findinas: Since the house is already existing at this lo-
cation a iesser variance would not grant the same property
right as others in this area and zone.
b. Conclusions: The variance requested is the minimum neces-
sary to grant the applicant the same rights as enjoyed by
others in the area and zone.
Criterion No. 5: '
The granting of the variance is not inconsistent with the goals
and policies of the Everett General Plan.
a. Findinas: The General Plan designation is Single Family
Detached, 5 to 10 dwelling units per acre.
b. Conclusions: The use is single family detached which is
consistent with the General Plan.
Criterion No. 6:
The need for the requested variance is not the result of a
self-created hardship.
a. Finding: The structure has been in the same location
since placed on the site in 1959 and the property was un-
der different ownership at that time.
Conclusions: The need for the variance is not a
self-created hardship.
NOW, THEREFORE, the Board of Adjustment of thz City of Everett
does hereby order that the variance be GRANTED to allow a rear
setback of less than 20 feet to legalize an existing single
family structure that has an approximata 10 foot rear setback.
The action of the Board of Adjustmerit in GRANTING a variance
shall be final and conclusive, unless within thirty (30) days
F from the date of issuance and siqning of this order by the
2
 I

I
