Our records indicate that you have been notified on <br /> at least two occasions by this department that certain portions <br /> of your property are classified as Environmentally Sensitive <br /> Areas as per Chapter 37 of the Everett Zoning Code; this includes <br /> areas with steep slopes exceeding a 40% grade, and the stream and <br /> associated buffer area of Narbeck Creek. Based upon our <br /> information, these appear to be the two areas of your property <br /> that were most seriously disturbed by the logging activities. <br /> The alteration of these environmentally sensitive areas is a <br /> violation of Section 19. 37. 230(B) of the Everett Municipal Code, <br /> which prohibits the unauthorized alteration of designated ESA's. <br /> Prior to determining the corrective measures which will be <br /> required to restore and enhance these disturbed areas, we will <br /> need to conduct an investigation of this property. This <br /> investigation will include members of City staff and <br /> representatives of state agencies with jurisdiction who have <br /> expressed an interest in this damaged watershed. <br /> It is my understanding that you have contracted with <br /> Shockey/Brent to work on a Restoration Plan for the Disturbed <br /> ESA's.
