Glen Dr.
Everett, WA. 98203
Re: Undeveloped right-of-way
Dear Dr. Khosravani:
I have been ashed to respond to your question regarding use of the City right-of-
way on the west side of your property. It is my understanding that the City has
not opened a road or sidewalks over the property in question but there are a
sewer main, a water main and storm drains located on the right-of-way.
Under Washington law, a right-of-way is only an easement for the City to develop
streets and run utility lines. The property is othenvise under the exclusive control
of the property owner. Where, as here, no road has been developed by the City,
ihe public gains no right of use, and the land owner is only limited in his use by a
requirement that he not interfere with the utilities that are in the right-of-way.
Very truly yours,
.= -,__
MARK T.
