Bortner and was a sinqle family residence <br /> foundation. He said the foundation wall leans and buckles to such an ex- <br /> tent that a plumb line passing through the center of gravity does not fall <br /> inside the middle one-third of the base. Resistance to �uind and earth- <br /> quake has been materially reduced and the foundation wall is an extreme <br /> hazard manifestly unsafe and in danger of immediate colla�se. He re- <br /> quested adoption of the xesolution authorizing demolition. <br /> Moved by Councilman Overstreet, seconded by Councilman IIaker to adopt <br /> resolution #1426 as follows : <br /> WIiEREAS on the 22nd day of March, '_978 the City o� Everett Building Officia <br /> or liis duly authorized representative requested the Everett City Council in <br /> regular public meeting to order the demolition of the structure as specifie <br /> in that certain NOTIC� OF UNSAPE BUILDING (5) dated the 20th day of Januar}� <br /> 1978 (Unsafe Buildings Reference No. 7801-23G) , a duplicate original copy <br /> of which is attached hereto and by this reference incorporated herein as <br /> though set forth in full herein, as the owner (s) of the unsafe Uuildin9 (s) , <br /> orstructure (s) or portion (s) thereof described in said notice has violated <br /> the provisions of the City of Everett Buildinq Code, Chapter 2 . 12 Everett. <br /> City Code adopting and amending the Uniform Building Code, 1973 Edition <br /> prepared by the Internat-ional Conference of IIuilding Officials and further <br /> requested the Everett Cit.y Council to order the City of Everett Building <br /> Official to proceed with the coork required and specified in said notice pur <br /> suant to and in accordance with said City of Everett Building Code on the <br /> grounds of the failure, r:eglect or refusal of said o�,�ner (s) to comply with <br /> the provisions of said notice, and <br /> WHEREAS the Everett City Council after examining exhiUits and hearing testi <br /> mony and arguments and being otherwise fully informed in the premises makes <br /> the follocaing findings : <br /> 1. That said City of Everett IIuilding Code is a valid existing <br /> ordinance of the City of Everett. <br /> 2. That the hereinabove descriUed NOTICE OL' UNSArE SUILDING (S) <br /> was properly is=ued and served pursuant to and in accordance <br /> �oith the hereinabove described City of �verett Building <br /> Code. <br /> 3. That the City of Everett IIuilding Official is authorized to <br /> request the Everett City Council to enter the hereinabove <br /> described order and that the Everett City Council is author- <br /> ized in the exercise of its discre�ion to sc do under the <br /> provisions of said City of �verett IIuilding Code. <br /> 4. That those named in said notice as the ocaner (s) of said <br /> unsafe building (s) , structure (s) , or portion (s) thereof <br /> were heretofore timely notified that the hereinaUove <br /> described request of the City of Everett Building Official <br /> would be presented to the Everett City Council in regul.ar <br /> puUlic meeting cn the hereinaUove mentioned date and that <br /> said o�aner (s) �oere further heretofore timely notified that <br /> the owner (s) or duly authorized representative (s) shall <br /> have L•he right to appear before and present such evidence <br /> and/or arguments to the Everett City Council relating <br /> to the herein described matter as may Ue desired in said <br /> regular public meeting on said dat�. <br /> 5.
