On June 2, 1992, the City of nverett issued Kevin Star , <br /> hereinafter referred to as "Applicant, " a Public Works Permit fo� <br /> a fence to �:- constructed in an unopened right-of-way between Algec <br /> Avenue and �ollege Avenue at the 4600 block in the city of Everett, <br /> washington. On June 17, 1992, Pastor J. B. F3randt (hercinafter <br /> referred to as "Appellant, " on behalf of the Zion Lutheran Chur�h, <br /> filed an appeal of the issuance of the Public Works Pertnit ,y92/173. <br /> I C� A hearing on the appeal was held before the Heariiig Examiner of the <br /> � <br /> � , city of Everett on July 23, 1992• The Hearing Examin�r held that <br /> � ���� the permit was properly granted and the appeal fails. A Motion for <br /> ��� <br /> ' Reconsideration was submitted on August 14 , 1992 , by the Appellant, <br /> � Zion Lutheran Church. On Sept=mber 1, 1992, the Hearing Examiner <br /> i �� <br /> denied the Appellant's Motion fcr Reconsideration and stated that <br /> f 1`�1 the decision as set forth in the July 31, 1992, decision of the <br /> Hearing Examiner remains as stated. <br /> ' � t-1 2 .
